Schiff Memo Blocked Because DOJ & FBI Under “Criminal Investigation” Says Former Federal Prosecutor

law enforcementTyler Durden – A former Federal prosecutor claims that the Democratic response to the House Intel Committee’s GOP-authored “FISA memo” was blocked on the recommendation of the FBI and DOJ because the agencies are conducting internal investigations into politically motivated malfeasance by specific individuals which the Schiff memo could compromise if released without redactions.

Joe DiGenova, a former Special Counsel who went after both the Teamsters and former NY Governer Elliot Spitzer, made the claim on a Monday interview with radio station WMAL.

DiGenova: “We’re going to see the [Democrat memo]. It will be heavily edited by the FBI and the Department of Justice and the CIA. The most important part of this story is that on Friday, February the 9th, Rod Rosenstein and Christopher Wray wrote a letter to the White House counsel Don McGahn that they could not agree to the publication of the Schiff memo because it contained national security and law enforcement concerns. It was actually the FBI and the Department of Justice saying no [to releasing the memo].

Two New Montana Laws Take On Warrantless Electronic Data Collection

warrantMichael Maharrey – On Sunday, two Montana laws went into effect that work together to ban warrantless collection of cell phone data in most situations. These laws not only increase privacy protections in the state, they also hinder one practical impact of federal surveillance programs.

Rep. Daniel Zolnikov sponsored both House Bill 147 (HB147) and House Bill 148 (HB148). Working together, these two bills require government agencies to get a warrant before obtaining data from electronic devices such as smart phones, computers and tablets in most situations.

HB147 prohibits any state or local government unit from obtaining the stored data of an electronic device without a warrant, unless it has the consent of the owner or authorized user of the device, or in accordance with judicially recognized exceptions to warrant requirements. The law will also allow police to access electronic data if the owner has already made the stored data public, or if there exists a possible life-threatening situation. Continue reading

privateAmanda Warren – People have this false idea of police incompetence. Just the opposite is true – in fact, as I keep saying, it is the training that directs their actions, not the lack thereof. In the last 15 years or so, law enforcement duties have coincided with militarized training, no-hesitation shooting tactics, other higher-up governmental departments and information/surveillance networks. Funding for such surveillance networks and militarized equipment keeps pouring in despite the media finally being allowed to criticize it, but with no real demands for change.

Federal and State Officers Take Life Savings From College Student Despite The Dropping Of All Charges

moneyJonathan Turley – We have previously discussed “policing for dollars” or “churning” where they seize cash, particularly on highways, as suspected drug money even without actually arresting or charging the drivers. It raises a huge amount of money for police departments and has been widely criticized as abusive. The latest victim of churning appears to be Charles Clarke, 24, who was on his way to take classes at the University of Central Florida. He was stopped at the Cincinnati/Northern Kentucky International Airport in Hebron, Ky. with his life savings that he was taking with him for safe keeping and to support his education. Since he could not “prove” the source of the money, agents seized the $11,000 and, despite dropping all charges against him, has thus far refused to return the money despite Clarke’s efforts.

The stop at the airport occurred after an airline employee reported that Clarke’s luggage smelled of marijuana. Police told him that he was free to go but asked to search him and his bags. Rather than walk away, Clarke consented and immediately told them that he had the cash on him. They found no drugs and he admitted that he had smoked marijuana before going to the airport.
