Court Rules That Members Of Bush Administration Can Be Sued For Crimes During War On Terror

rulingJohn Vibes – Years ago, the case of Turkmen Vs. Ashcroft set the precedent that the Bush administration could be held accountable for the actions that it took to harm innocent people during the war on terror. However, the case has been in limbo for several years as constant appeals have been filed against the ruling.

Recently, The Second Circuit Court of Appeals finally rejected the appeal and ruled that people can, in fact, sue members of the government for enacting policies that result in trauma or injury. It is likely that this ruling sets a precedent for all members of the government and not just the Bush administration.

The Turkmen Vs. Ashcroft case involved a number of immigrants who were rounded up and tortured after the 9/11 attacks and were later found to be completely innocent. Muslim prisoners were fed pork intentionally by the guards who would abuse and insult them on a regular basis, leaving them in deplorable conditions, in total isolation with the lights on 24 hours per day. These people were never even charged with any crimes, they were detained without a trial.

“We simply cannot conclude at this stage that concern for the safety of our nation justified the violation of the constitutional rights on which this nation was built. The question at this stage of the litigation is whether the [eight arrested foreigners] have plausibly pleaded that [feds] exceeded the bounds of the Constitution in the wake of 9/11. We believe they have,” judges Rosemary Pooler and Richard Wesley wrote in their decision.

America’s War On Whistleblowers And Journalists Since 9/11

Joachim Hagopian – With 2014 fresh in our rear view mirror, an honest examination of events and developments of what’s been happening in America to whistleblowers and journalists since 9/11 under the Bush-Obama regime seems a worthwhile review, however disturbing and foreboding. By definition a whistleblower is an individual who reports an employer’s misconduct.   The  Whistleblower Protection Act of 1989 (WPA) is a law that protects federal government employees in the United States from retaliatory action for voluntarily disclosing information about dishonest or illegal activities occurring within a government organization. Yet despite these supposed legal protections in place, those who have gone public disclosing illicit and immoral behavior by the federal government have been consistently singled out for discrimination and excessive punishment.

In fact, more American citizens have been indicted for allegedly violating the Espionage Act of 1917 under the current president than all other previous presidents combined. Though the law was designed to punish WWI German spies, and rarely used since for indicting those selling secrets to the enemy or efforts to undermine the American way of life, it is completely obsolete. Yet it is being misused by Obama for purely political purposes to shut down the truth. The Obama administration has also turned down more Freedom of Information Act requests than any other prior presidency with each year the denial rate rising. 2013 was 57% more than the year before, with over half the total requests rejected. Of course Obama’s mantra excuse is always using the “national security” card. He has also jailed more whistleblowers and journalists than any other president.

By his over the top, punitive methods, Obama has declared war on the first amendment right to a free press in America, threatening, harassing, indicting and imprisoning those brave enough to speak the truth, accusing them of treason when the president through his administration has repeatedly violated the very Constitution that he has sworn to protect and uphold as the so called leader of the free world. His malevolent attack on free speech is even more incriminating and inexcusable as a Harvard educated lawyer who once taught constitutional law at the University of Chicago. Continue reading →

CheneyEvilThe CIA torture program is fully exposed to the world and there goes Dick Cheney – still alive, still defiant, still selling tyranny, dictatorship and fascism to anyone who will listen. Every time the man speaks he seems to be attempting to speak to your consciousness with the voice of darkness and evil. The voice seems to be saying- “Bad is good, eye for an eye, survival of the fittest wins, he who has the biggest gun wins, kill or be killed, the ends justifies the means.” Now where have I (we) heard this before? Who thinks this way? Who declares boldly that anything goes, murder and torture is fair game, love and peace is weak and useless, might and force rules, and thinks that we live to kill enemies?

I remember now – it‘s the villains in every movie we watched as children. It was the villain in every cop show we watched growing up. Remember the bad guys that always died at the end? The ones whose missions almost succeeded except for the actions of a superhero, or hero cop, detective, agent or investigator saving the day.

I remember the typical villains in old shows and movies – They never felt like they owed anything to humanity. Everything they did was for themselves. They were consumed in egoism and selfishness. The villains of old movies and TV shows never felt responsible for anything they did and they never felt any guilt when doing something evil. Remember those typical personality profiles of the evil villains?

Lawrence E. Rafferty ~ The CIA Lost Its Soul And Took Ours With it

CIA-BadgePOTUSThis past week’s news reports of the Senate report on the CIA Torture program were both distressing and enlightening.   I was dismayed to not only read what the full extent of the CIA’s Torture program was, but also when I read pundits and former CIA officials claim that rectal rehydration was merely a medical procedure! I was further discouraged when commenters on this blog made claims that waterboarding and other torture tactics were either necessary or what the devils deserved.

Very few pundits or commenters seem to care if the so-called Enhanced Interrogation techniques were legal or ethical when the CIA resorted to them shortly after 9/11.  This “debate” over the actions taken in our name by the CIA has gone from a report based on the CIA’s own words to denials that the techniques were torture, to claims that great intelligence value was gained using the torture and claims that it was a biased report written by Democrats.

When we were attacked on September 11, 2001, most of the world was supporting the United States in its hours of grief and anger.  What happened after the attacks quickly turned the tide of world opinion against us and created new enemies.  When the CIA delved into its historical “playbook” to devise black sites and brutal interrogation techniques, the result, in my opinion, was a loss of our ethical and legal bearings that are still out of whack today.

When our greatest generation fought enemies stronger and just as brutal as what we face today, our forces were held to a higher standard than the enemy we were fighting.  The idea that America does not torture or mistreat its prisoners or enemies is not a new one.  It dates back at least to when General George Washington decided that British regulars and paid mercenaries fighting for the British were not to be mistreated in our detention facilities.
